TERRELL, Justice.

Homme brought his action in the District Court for the County of Brazoria against O’Connor to recover the value of work and labor done and performed by the plaintiff, Van Homme, upon a house built by him for the defendant O’Connor.

The plaintiff declared upon a special agreement and likewise upon a quantum meruit. The case was submitted to a jury, who returned the following verdict: “We the jury in this case find for the plaintiff four hundred and ninety-one dollars.” Upon this verdict the court rendered the following judgment: “It is therefore considered by this court,…
