HALL, Justice.

Appellant, plaintiff below, brought this suit in trespass to try title in the District Court of Rusk County against appellee and others for title and possession of the ⅞ leasehold interest in 10.67 acres of land, a part of the McCabe Survey located in said county. Situated on the disputed tract of land are three producing oil wells. It was alleged by appellant, hereinafter referred to as Luling, that the judgment in the cause of Still v.
