This is an appeal by the defendant, Kenneth J. Porter, from his conviction in the Court of Common Pleas of Summit County for receiving stolen property, having been previously convicted of a theft offense under R. C. 2913.51. We affirm.

In 1969, the defendant pled guilty to four counts of breaking and entering an inhabited dwelling in the daytime. In 1972, he pled guilty in Akron Municipal Court to petit theft. On both occasions he was sentenced.

On October 20, 1975, the Summit County Grand Jury indicted defendant on three separate counts of receiving stolen property. On February 24, 1976,…
