KRUEGER, Judge.

The offense is murder. The punishment assessed is confinement in the State penitentiary for a term of seventeen years.

The State’s testimony, briefly stated, shows that on Saturday night of April 27, 1940, the appellant drove up to the home of Alfred Martin, with whom Jack Main, the deceased, made his home; that he drove into the drive-way on the north side of the house and “honked” his horn.
