The city of Seattle instituted a condemnation proceeding in the superior court of King county, seeking to acquire certain state school and capitol building lands situated outside the city limits for use in connection with its proposed Tolt river reservoir. An order adjudicating public use was entered, and the state petitioned for a writ of certiorari, alleging that the court was proceeding without jurisdiction, and that there was no appeal, nor any plain, speedy and adequate remedy at law.
