This is an action of forcible entry and detainer, under the Gen. Sts. c. 137. The undisputed facts are these: Eben 1ST. Price owned a lot of land with a building on it upon the corner of Essex and Washington Streets, in Salem. In 1867 he leased that estate to one Fogg, for the term of twenty years. In the spring of 1875, a fire occurred in the building which rendered it substantially untenantable. In the summer of that year, a controversy existed between Price, the owner of the building, and Fogg, the lessee, as to their rights in the building and the land under it. The particulars of that…
