WEINFELD, District Judge.

The petitioner, now confined at Green Haven State Prison pursuant to a judgment of conviction entered in the Supreme Court, Kings County, on a jury verdict, seeks his release on a writ of habeas corpus. He was found guilty of robbery in the first degree, grand larceny in the first degree, and assault in the second degree. They were cognate charges based upon a single holdup. The petitioner was sentenced on the assault charge to a term of two and a half to five years; on the robbery charge from fifteen to thirty years, and on the larceny charge from five to ten years.…
