Alfred Hannigan filed a complaint in the superior court of Cook county against Elgin, Joliet and Eastern Railway Company under the Federal Employers’ Liability Act to recover damages for personal injuries alleged to have been sustained while employed as a brakeman on March 10, 1947, when he fell from the brake platform of a boxcar in defendant’s yards at East Joliet, Illinois. Sec. 51, title 45, USCA, provides that every common carrier in commerce between the states shall be liable in damages to any person suffering personal injury…
