NEILL, Associate Justice.

The term of the court at which the judgment appealed from.was rendered ended on the 13th day of December, 1900. On that day the appellant, defendant in the court below, was allowed ten days after adjournment in which to prepare and file a statement of facts. It was not filed in the court below until the 24th day of December, and appellees move to strike it out upon the ground that it was not filed within the required time.
