The exception is to the overruling of a demurrer to a petition in two counts. For the purposes of the decision the substance of them may be stated as follows: The first count seeks recovery of damages from the plaintiff’s immediate grantor and on the general covenants of warranty. Both deeds are in the same form, and convey the property by the same words of description.
