Mrs. Catherine C. Lanahan, of Baltimore County, Maryland, died on February 13th, 1920, leaving a will which contained the provision: “I hereby constitute and appoint H. Charles Burke to be the sole executor of this Will; but in case of his death, resignation, disqualification for any reason, or his refusal to act as.such executor, then I appoint hereby the Safe Deposit and Trust Company of Baltimore to succeed him and tó be the executor of this my Will.” The will was admitted to probate and letters testamentary were duly granted to H.
