1. Introduction
In its Third Counterclaim against Gemini Investors, Inc. (“Gemini”), Ches-Mont Disposal, LLC (“Ches-Mont”) alleges a claim for breach of fiduciary duty. (# 94 ¶ ¶ 103-106) Gemini takes the position that this counterclaim lacks merit and so has moved in limine to exclude any reference to any purported fiduciary relationship.
