Defendant appeals from a conviction under R. S. 21-435. His abstract contains no specifications of error, but we shall discuss the contentions made in his brief.

It is not necessary that a complete statement of facts be made. It is sufficient for our discussion to say the state’s evidence showed that one Hopkins and another man and his wife and their two children left Protection, Kan., in a motor car on the night of March 9, 1935, and started for their home, which was in Oklahoma, one mile south of the north state line and about fifteen miles…
