1. The provision of the Civil Code (1910), § 6093, to the effect that “documentary evidence copied as an exhibit . . and introduced in evidence shall not be set out in the brief except by reference to the same,” while mandatory, is for the benefit of the court and not of the parties litigant. The motion to dismiss the bill of exceptions upon the ground that the above provision has been violated by the plaintiff in error is overruled.
