This is an action instituted by appellee against appellant to recover damages alleged to have been sustained by reason of negligence in the transmission of a telegraphic message from New Orleans, Louisiana, to Blytheville, Arkansas. Appellee is described in the complaint merely as ‘ ‘ T. C. Davis 'Cotton Company, plaintiff, ’ ’ without stating whether the plaintiff is a corporation or a partnership or an individual.
