This case comes before the court on plaintiffs exceptions to the recommended decision (including an opinion, findings of fact, and conclusions of law) filed by Senior Trial Judge Mastin G. White. After hearing oral argument and considering the exceptions and briefs of the parties, and the record, the court hereby adopts the *214trial judge’s findings and opinion, as supplemented by the following, as the basis for its judgment in the case.1
