This case comes here by appeal from an order denying a motion to vacate a default judgment. The action was filed by Big Four Petroleum Co., a corporation, *525as plaintiff, against Harry E. Turner, Jr., as defendant, and the parties will be referred to as they appeared in the trial court.

By its petition, filed August 28, 1951, plaintiff sought to recover from defendant, as cotenant in an oil and gas leasehold estate, the sum of $4,808.98, his alleged proportionate share of drilling an oil well on the real estate under lease.
