This case was referred pursuant to Rule 54(b) to Trial Commissioner Robert K. McConnaughey with directions to make his recommendation for conclusion of law on defendant’s motion for summary judgment. The commissioner has done so in an opinion filed April 1, 1965, wherein he recommended that the defendant’s said motion be granted and the petition dismissed. It appears to the court that plaintiff has failed to file a request for review by the court of the commissioner’s recommendation for conclusion of law pursuant to the provisions of Rule 55(b) and that the time for so doing has expired.…
