Before the Court is the motion (“Motion”) of defendant, Pinnacle Foods, Inc. (“Pinnacle”), seeking mandatory abstention and remand, discretionary abstention and remand or equitable remand of this action (“Action”) to the Court of Common Pleas of Montgomery County (“State Court”) where it was originally commenced.
