This action, heard before me by agreement without a jury upon an agreed-stipulation of facts hereby adopted as findings of fact herein under Rule 52(a), Rules of Civil Procedure, 28 U.S.C.A. following section 723c, involves the right of the plaintiff as receiver of the insolvent First National Bank of Spartanburg, South Carolina, to recover of the trust estate created under the will of J.
