This case is before the court on an appeal of a decision by the Commissioner of the Virginia Department of Motor Vehicles (DMV) in an administrative proceeding. The Commissioner found that Mitsubishi Motor Sales of America (MMSA) failed to show good cause in terminating a franchise agreement with West Broad Mitsubishi (WBM), a car dealership in Richmond. In so finding, the Commissioner, applying Va. Code §§ 46.2-1569 and 46.2-1573(D), considered evidence that WBM added another line of cars from another manufacturer, Hyundai, to be sold and serviced from the same…
