Order and judgment unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Defendants appeal from that part of an order and judgment that granted plaintiffs’ motion for partial summary judgment on the issue of liability under an indemnification agreement and adjudged that defendants are liable to plaintiffs for damages including attorney’s fees pursuant to that agreement.
