HARRIS, District Judge.

An indictment was found and returned against defendants Harry Renton Bridges, Henry Schmidt, and J. R. Robertson. The several counts, embraced in the indictment, are as follows, to wit:

“FIRST COUNT-. (18 U.S.C., Section 88; Now 18 U.S.C. Section 371 [18 U.S.C.A. § 371])......on or about the 23rd day of June, 1945, and continuing thereafter until on or about October 1, 1945, and for some time prior thereto, the exact time being to the Grand Jury unknown, at the City and County of San Francisco, State of California, within said Division and District, did conspire with…
