Dependant in error, Martin Zupet, came before the Industrial Commission claiming compensation for injuries “caused by an accident arising out of and in the course of his employment” with plaintiff in error, the American Mining Company, August 29, 1932. The injury, as he alleges, was sustained while he was breaking rock with an iron or steel sledge and was caused by pieces of rock, iron or steel striking his face and eyes, becoming imbedded therein, and particularly injuring his eyes, ears and head.
