MEMORANDUM OPINION AND ORDER

THIS MATTER came on for hearing on cross Motions for Summary Judgment filed by the debtor, Hatfields & McCoys, Inc., the plaintiff herein, and Mid-State Federal Savings & Loan Association (Mid-State). The parties agree that there is no dispute as to the facts concerning the transactions between them.
