Kun, J.,
The city filed a claim against the estate of the incompetent for reimbursement for his care and maintenance as an insane or weak-minded person. It appears that on June 9, 1922, while in the county prison in Philadelphia awaiting trial on a criminal charge, the incompetent was declared insane by a lunacy commission appointed by the court. On July 15, 1922, he was transferred to Farview State Hospital, and has been maintained there since at the expense of the City of Philadelphia.
