This matter is before the court on plaintiffs motion for summary judgment and defendant’s cross-motion for summary judgment. This matter is an appeal to the court, pursuant to the Wunderlich Act, 41 U.S.C. §§ 321-322 (1988), from a decision by the Agriculture Board of Contract Appeals (AGBCA or Board) concerning a construction contract.
