The defendant was accused of murder in the first degree. He was tried by a jury and convicted of mu-rder-in the second degree. Thereafter, he filed a motion for a new trial predicated on the refusal of the trial court to instruct the jury as to manslaughter. This motion was denied and the trial court sentenced the defendant to 10 to 12 years in the penitentiary.
