This is a motion by A. J. Richardson against H. M. Gleason and Company, Incorporated, International Harvester Company, and Dayton Steel Foundry Company to recover a judgment for damages in the sum of $1,224.33. The plaintiff charged the defendants both with the breach of their implied warranty that a coupling device, commonly called a fifth wheel, designed for use in fastening a trailer to a tractor, was reasonably fit for the purpose for which it was sold to him, and with negligence “in the selection, inspection and sale for use of the said fifth wheel,” which caused an accident resulting in…
