MEMORANDUM OPINION

This matter comes before the court on Northwest Farm Credit Services, FLCA’s (Farm Credit) motion to dismiss. The matter has been heard and is now ripe for decision.

Facts:

Debtors Bill Osborne (Bill) and Mary Jane Osborne (Mary Jane) own various parcels of farmland in and around Tule-lake, California. Bill is a third generation farmer, who historically farmed with his father, James Osborne (James), who owned nearby land.
