Appeal from an order of the Supreme Court (Torraca, J.), entered August 9, 1996 in Sullivan County, which denied defendant’s motion for summary judgment dismissing the complaint.
In December 1993, defendant signed a criminal information charging plaintiff with unauthorized use of a motor vehicle in the third degree. The charge was later dismissed at the request of the prosecutor "in the interest of justice” (CPL 170.40).
