The defendant, Goldie Newton, individually and as an heir at law of Louie Newton, deceased, appeals from a judgment of the Circuit Court of Sangamon County entered August 29, 1958, in a suit on a forthcoming bond.

The record discloses that the judgment under review was preceded by protracted litigation which began September 8, 1951, when Universal C. I. T. Credit Corporation, (referred to herein as Universal) sued out a replevin writ against the defendant Barbara Thompson to recover possession of a 1951 Hudson automobile. The Sheriff of Sangamon…
