The appellant was convicted in the District Court of Baylor County for the offense of rape, and his punishment assessed at five years in the penitentiary.

The appellant was indicted in the District Court of Knox County on the 21st day of September, 1925, and the court thereafter, on his own motion, changed the venue of this case to Baylor County.
