In an action, in which the complaint alleges that through fraudulent representations by the individual defendants, who were the officers, directors and owners of all of the corporate defendant’s outstanding capital stock, plaintiff was induced to purchase 50% of such stock for the sum of $45,000, of which $25,000 was paid and $20,000 was to be paid in the future; and in which judgment is sought: (a) for $25,000, with interest; (b) requiring the defendants to surrender any writings wherein plaintiff obligated himself to pay the corporate defendant $20,000 on or before a specified date in the…
