HOGAN, Judge.

This appeal is taken from an order refusing specific performance of an alleged agreement by the defendant to convey certain interests in land to the plaintiff, upon plaintiff’s payment of the sum of $2,000.00 and the performance of certain other acts for the defendant’s benefit.
