The controversy determined by the judgment relates to the title of Moses G. Wanzor to a lot of land in Greenwood cemetery. It was purchased and a deed taken for it from the Cemetery Association by John Schroder, the plaintiff’s husband, and he executed and delivered a deed of the same lot to the appealing defendant. The plaintiff claimed to have become so far interested in the property by its improvement, and the interment of her parents, as to prevent her husband from making a legal or valid sale of it.
