This was an action in replevin, commenced by the plaintiff below, in the district court of Bourbon county, to recover fifty tubs of butterine from the sheriff, who held the same by an order of attachment issued against the property of T. W. Price and D. B. Fabyan, who had been doing business in Fort Scott under the name of T. W. Price & Co., but had sold out their business some time before the attachment was issued.
