1Opinion of the CourtMaxwell, J.

Joseph M. Ocheltree, Campbell Hiffe, and twelve others, on the first Monday in September, 1859, filed their bill in the circuit court of Greenbrier county, to set aside the probate of the will of Eliza McClintic. The will *250bears date on the 28th of March, 1889, and was probated in the county court of Greenbrier county at the March term, 1840 thereof. The bill charges that the complainants, togethe. with Hern and wife, who are made defendants, are the heirs at law of the said Eliza McClintic, who was a married woman, and by virtue of a marriage contract, the owner of certain lands, with power…
