This mandamus proceeding arises out of a custody dispute currently pending in the Winston Juvenile Court. In April 2008, J.A.H. (“the mother”), an Alabama resident who is the mother of E.C.H., a minor child born in June 2006 (“the child”), filed a civil action in the juvenile court seeking an award of custody of the child. On June 13, 2008, the juvenile court entered an interlocutory order granting pen-dente lite custody of the child to the mother. The child’s paternal grandmother, C.J.A.
