The plaintiff in error, hereinafter referred to as the defendant, was charged by information with maintaining and operating a certain two-story frame building wherein intoxicating liquor, to wit, whisky, was kept, 'bartered, sold, and given away and otherwise furnished to divers persons unknown, to- the common nuisance of the public; was tried and convicted; and sentenced to pay a fine of $100 and to be confined in the county jail for 90 days. Prom the judgment the defendant has appealed.
