ROSENN, Circuit Judge.

This appeal presents several interesting questions- arising out of an alleged constitutional tort committed by a township school district and its superintendent in the arrest and prosecution of one of their teachers for the unlawful removal of school supplies. The plaintiff, Lou Ann Merkle, formerly a teacher at the Upper Dublin School District (“the District”), filed this action in the U.S. District.
