This suit is the final phase of several other suits filed by the parties hereto and in order to clarify the matter we are first going to outline prior proceedings.

Bennie Tucker, the plaintiff in this suit was struck by a truck owned and' operated by the Department of Highways, State of Louisiana in St. Helena Parish on May 25, 1952. At that time the Marquette Casualty Company was the insurer of the Department of Highways of the State of Louisiana on all automobile and truck accident cases.
