This was originally a foreclosure action to which the appellant was not a party. He purchased the land at the sheriff’s sale under the foreclosure decree on the 10th of May, 1915, paid the amount of his bid, $300, and the sale was confirmed on the 24th day of June, 1915'. The certificate of purchase issued by the sheriff stated that the purchaser would not be entitled to a deed until the expiration of nine months from the date of the sale, which would be February 10, 1916.
