MEMORANDUM ON MOTION TO COMPEL PAYMENT OF TAXES

DONALD MacDONALD IV, Bankruptcy Judge.

Anchorage Community Development’s (ACD) motion to compel payment of real property taxes and for adequate protection duly came before the court for hearing on October 27th and 28th and November 5, 2010. Numerous briefs and exhibits have been submitted by ACD and U.S. Bank as indenture trustee for the bondholders. Testimony has also been presented. This court has jurisdiction over the controversy pursuant to 28 U.S.C. § 157(b)(2)(A) and the district court’s order of reference. I conclude that ACD’s motion to…
