delivered the opinion of the court.

The question involved in this case is whether the appellant is entitled to a private right, of way over the lands of the appellee.

It appears that the way claimed by the appellant has been used for more than forty years by her and her predecessors in title without objection, until about August, 1908, when the appellee built, a wire fence across the way which obstructed its use by the appellant.
