This is a suit growing out of a controversy over the lease of a certain tract of land purchased from the allottee, by George Lehmer, appellee, who was plaintiff in the court below, and who brought the suit in the United States court for the Western district of the Indian Territory, sitting at Muskogee, against Edwin Whitham, who was claiming possession of the same under a lease or leases, executed by the allottee prior to the sale.
