Burr, J.:
On April 22, 1902, a tripartite agreement was entered into between plaintiff, defendant and John F. Carson, as trustee of plaintiff, in accordance with which plaintiff, defendant’s wife, has been living separate and apart from him. By the terms of this agreement defendant was to pay “for and towards the better support and maintenance of his said wife the sum of Twenty-five dollars at the beginning of each and every week ” Plaintiff agreed to accept such sum “in full satisfaction for her support and maintenance and all alimony whatever. ” Plaintiff admits that she has' received the…
