(dissenting).—I am unable to agree either with the conclusion reached by the majority, or the process of reasoning by which that conclusion is reached, nor am I able to agree with the conclusions reached by Mr. Justice Brown, in his concurring opinion, that the Act under consideration, Chapter 18296, Laws of 1937, “must be held constitutional as against all attacks here made upon it.”
I find in Section 1 of the Act an anomalous attempt to enact into law the statement of facts set forth in that .section as a basis for the provisions which follow in other sections. That section is an apparent…
