This is an appeal from a judgment in favor of appellee in an action by him against the appellants to recover damages for an injury to his person. The jury found appellants guilty, and assessed appellee’s damages at the sum of §10,000. On motion for a new trial, appellee’s counsel, on suggestion of the court, remitted §5,000, and judgment was entered for §5,000. It was assigned as a reason for a new trial, and is relied on here, that the verdict is not supported by the evidence; that it is excessive, and the result of passion and prejudice,…
