The appellant, Steven Jeffery Cain, was convicted of violating the Uniform Controlled Substances Act by possessing marijuana. See § 13A-12-213, Code of Alabama 1975. He was sentenced to three years in prison.

The evidence tended to show that on September 22, 1988, the appellant was stopped for driving in a reckless manner. When the officer approached appellant's car and asked for his driver's license, he noticed a strong smell of marijuana.
